Marina Fort Louis: the Collectivité has extended the Semsamar concession for another two years
Since June 2000, Marina Fort Louis has been managed in the context of a public service delegation (DSP) by the Semsamar, more specifically by one of its subsidiaries, the Samagest, according to an agreement between the two parties. Initially, this agreement was supposed to end on December 31, 2015. According to a contract amendment in December 2015, it was extended for one year, in other words until the end of this year.
At the same time, the Collectivité launched its project for the development of Marigot bay. It must, therefore, choose a concessionaire to carry out this development and also to operate the marina, which happens to be the Marina Fort Louis.
In this perspective, "It is therefore necessary and coherent to extend the concession agreement for two years with the current operator so that its term coincides with the designation of the future concessionaire", said the majority.
During the debate, the Opposition leader argued that "Providence was in favor of the majority". Daniel indeed believes that the Collectivité is lucky to be able to extend the public service delegation once again with the Semsamar. "This is possible due to a law dating back to February 2016 which is beyond our control. However, in 2015, when the public service delegation was extended, the law allowed it for an indefinite period but only once. In other words, if there hadn’t been this law of February 2016, the Collectivité would not have been able to extend the public service delegation today and would have had to reimburse the Semsamar 2.7 million euros," said Daniel Gibbs, based on a contract amendment stating that the concessionnaire [editor's note: the Semsamar] must be compensated for the amount corresponding to the accounting value of undepreciated investments at the term of the contract.
The elected officials who were gathered in a plenary session on Thursday validated the extension of the contract between the Samagest/Semsamar and the Collectivité until December 31, 2018.
